Rogers Collective LLC ("Rogers Collective," "Upmaking," "we," "us," or "our") operates Upmaking, including the website at upmaking.ai and related services (collectively, the "Service").

This Privacy Policy explains what information we collect, how we use it, when we disclose it, and the choices available to you.

By using Upmaking, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

Account Information

If you create an Upmaking account, we may collect information such as:

• your email address;
• authentication and account identifiers;
• account status; and
• information necessary to maintain and secure your account.

Authentication and account services are provided using Supabase.

Project and User Content

When you use Upmaking, you may provide content including:

• project ideas and descriptions;
• questions, instructions, or other text you submit;
• photographs or images you upload;
• project preferences;
• requests to refine or modify a project; and
• other information you voluntarily provide through the Service.

Upmaking may send this information to artificial intelligence service providers, including OpenAI, as necessary to generate project plans, analyze submitted images, create Project Visuals, refine results, and provide other AI-powered features.

Please do not submit confidential, highly sensitive, or personally identifying information that is not necessary to use the Service.

Generated and Saved Content

We may process and store:

• project plans generated through Upmaking;
• materials lists, instructions, tips, assumptions, and other generated content;
• saved projects;
• Project Visuals;
• project titles and categories; and
• related project information associated with your account.

Subscription and Billing Information

Upmaking Plus subscriptions are processed through Stripe.

Stripe collects and processes payment information necessary to complete your purchase. Upmaking does not directly store your full credit or debit card number.

We may receive and store billing-related information such as:

• your Stripe customer identifier;
• subscription identifier;
• subscription status;
• pricing plan identifier;
• current billing-period information; and
• whether your subscription is scheduled to cancel.

Usage and Technical Information

We may collect information about how the Service is used, including:

• project-generation activity;
• refinement activity;
• account and subscription activity;
• saved-project activity;
• error and diagnostic information;
• request and server logs; and
• information reasonably necessary to enforce usage limits, maintain security, prevent abuse, and operate the Service.

Our hosting and infrastructure providers may also automatically process technical information such as IP addresses, browser information, device information, and request metadata as part of providing their services.

Communications

If you contact us, we may collect your email address and the content of your communication so that we can respond to you and maintain appropriate support records.

• provide, operate, and maintain Upmaking;
• authenticate users and manage accounts;
• generate and refine project plans;
• analyze images submitted by users;
• generate Project Visuals;
• save and retrieve projects;
• provide Upmaking Plus features;
• process and manage subscriptions;
• enforce free and paid usage limits;
• provide customer support;
• troubleshoot technical problems;
• monitor the security and reliability of the Service;
• detect fraud, abuse, or misuse;
• improve the functionality and user experience of Upmaking;
• comply with applicable laws and legal obligations; and
• protect the rights, safety, and property of Rogers Collective LLC, our users, and others.

3. Artificial Intelligence Processing

Upmaking uses third-party artificial intelligence technology, including services provided by OpenAI, to generate project plans, interpret project-related inputs, analyze submitted images, create Project Visuals, and provide related functionality.

Information you submit to AI-powered features may be transmitted to and processed by these providers for the purpose of providing the requested feature.

AI-generated results may be inaccurate, incomplete, or unexpected. Please review Upmaking's Terms of Use for important information regarding AI-generated project guidance and safety.

4. How We Disclose Information

We may disclose information to service providers that help us operate Upmaking, including providers of:

• artificial intelligence services, including OpenAI;
• database, authentication, and storage services, including Supabase;
• payment and subscription services, including Stripe;
• website hosting and infrastructure services, including Vercel; and
• technical, security, and operational services.

These providers may process information on our behalf or as otherwise described in their applicable terms and privacy policies.

We may also disclose information:

• when required by law, court order, subpoena, or other valid legal process;
• when reasonably necessary to investigate fraud, abuse, security incidents, or violations of our Terms;
• when necessary to protect the rights, property, or safety of Rogers Collective LLC, our users, or others; or
• in connection with a merger, financing, acquisition, sale of assets, restructuring, or similar business transaction.

5. Sale and Targeted Advertising

We do not sell personal information in exchange for money.

Upmaking does not currently use personal information for cross-context behavioral advertising.

Upmaking and its service providers may use cookies, local storage, authentication tokens, and similar technologies that are necessary to:

Upmaking is a general-audience service and is not directed to children under 13.

Children under 13 may not create an Upmaking account or submit personal information to the Service.

If we learn that we have collected personal information from a child under 13 without legally required parental consent, we will take reasonable steps to delete the information.
